The compatibility of data trusts with the General Data Protection Regulations (GDPR)

In this legal analysis, data protection expert Michael Funke examines whether so-called data trusts can act as intermediaries for personal data, acquiring individual data donors’ rights to their personal data, in order to manage it on behalf of such donors – enabling data trusts to both pass personal data on to third parties and represent the data donors’ rights vis-à-vis these third parties. Arriving at the conclusion that the EU’s General Data Protection Regulation (GDPR) does not allow this transfer of rights in its current form, he presents some concrete proposals for how the GDPR could be amended to afford this.
